Terms of Service
1) Agreement
These Terms govern your access to and use of Flout's services, including any websites, dashboards, APIs, domains, and webhook/request routing features (the "Service").
If you use the Service on behalf of a company, you confirm you have authority to bind that company, and "you" means that company.
2) What the Service is
The Service is infrastructure that receives, routes, stores, and/or forwards HTTP requests and related metadata as configured by you.
3) No uptime or delivery guarantee
The Service is provided "as is" and "as available." We do not guarantee uninterrupted availability, any specific uptime percentage, zero latency, error-free operation, or that requests will always be received, stored, forwarded, or delivered.
Outages, delays, failures, and data loss can happen. You accept this risk by using the Service.
4) Not for mission-critical use
You must not use or rely on the Service where failure could reasonably be expected to cause harm, injury, or major financial loss (for example: emergency services, medical/life-support, critical infrastructure).
5) Your responsibilities
You are responsible for:
- your configurations, endpoints, secrets, and access controls
- validating inbound requests and securing downstream systems
- backups of anything you care about (do not treat the Service as your only system of record)
- ensuring your use complies with all laws and third-party terms
6) Acceptable use (no abuse)
You must not use the Service to:
- break the law or infringe rights
- transmit malware, exploit code, or conduct unauthorized scanning
- facilitate spam, phishing, or deceptive behavior
- overload, interfere with, or attempt to bypass limits or safeguards
- attempt unauthorized access to accounts, systems, or data
- resell/white-label the Service or provide it to third parties without written permission
We may throttle, suspend, or terminate access immediately if we believe your use is abusive, unsafe, unlawful, or risks harm to the Service or others.
7) Security
We use reasonable measures to protect the Service, but no system is perfectly secure. You acknowledge that unauthorized access, data loss, and third-party attacks can occur. You are responsible for securing your own systems and for what you send through the Service.
8) Third-party services
The Service may depend on third-party networks and providers (hosting, DNS, cloud, telecoms, etc.). We are not responsible for third-party outages or failures.
9) Fees and taxes (if applicable)
If any part of the Service is paid:
- fees and usage-based charges are as shown at purchase or in your dashboard
- taxes (including VAT) may apply
- non-payment may result in suspension or termination
10) Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access immediately for abuse, legal compliance, or security risk, or with notice where reasonably possible for operational reasons.
11) Intellectual property
We own the Service and all related software and content, excluding what you send through the Service. You retain your rights to your content.
You grant us a limited license to process your content only to operate, maintain, secure, and improve the Service, and to comply with law.
12) Disclaimers
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement. We do not guarantee that the Service will meet your requirements or be compatible with any specific system.
13) Limitation of liability
You use the Service at your own risk. To the maximum extent permitted by law:
- No indirect losses. We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, business, goodwill, data, or anticipated savings.
- Cap on direct liability. Our total liability for all claims will not exceed the greater of the total fees you paid in the 3 months before the claim, or €100.
- Legal carve-outs. Nothing limits liability that cannot be limited under applicable law (including for death/personal injury caused by negligence or fraud).
14) Indemnity
You will defend, indemnify, and hold Flout harmless from any claims, damages, losses, and expenses arising from your use of the Service, your content, your systems, your breach of these Terms, or your violation of law or third-party rights.
15) Changes
We may change the Service and these Terms. We will update the "Last updated" date. Continued use means you accept the updated Terms.
16) Governing law and disputes
These Terms are governed by the laws of Ireland. Courts of Ireland will have jurisdiction, except where mandatory consumer protections require otherwise.
